Intellectual Property

DBV Technologies website (hereinafter the “Website”) and all elements related to it (pictures, texts, videos, trademarks, product names, etc.) are the exclusive property of DBV Technologies or has been licensed to DBV Technologies. Reproduction of all or part of the Website and/or of any matter related to the Website, without DBV Technologies’ consent, is expressly forbidden.

Hypertext links to the Website may only be established with the prior written consent of DBV Technologies. DBV Technologies shall not be liable for the content of any website linked to the Website by hypertexts links.

General Terms of Use

1. Purpose

These General Terms of Use (hereinafter referred to as “Terms of Use”) govern the access and use by users of the site www.dbv-technologies.com (hereinafter referred to as the “Site”).

The Site is published by the company DBV TECHNOLOGIES (hereinafter referred to as “DBV TECHNOLOGIES”).

The purpose of the Site is to inform Internet users, presenting DBV TECHNOLOGIES, its activities, products and news to them. It also allows users to post online information requests to DBV TECHNOLOGIES and subscribe to the email alerts.

Any access, consultation and/or use of the Site implies full and unreserved acceptance of the Terms of Use. DBV TECHNOLOGIES reserves the right to modify the Terms of Use at any time. These modifications will be applicable as soon as they are posted on the Site so that users are responsible for reading the Terms of Use in force when they access, consult or use the Site.


2. Site Access

The Site is accessible 24 hours a day, 365 days a year. However, DBV TECHNOLOGIES reserves the right to modify, suspend access or close the Site for any reason at any time, without having to justify this to users.

Any costs and expenses relating to the Internet connection and the equipment to access it are the sole responsibility of the users.


3. Warranties and Liability

DBV TECHNOLOGIES strives to make truthful and relevant information available online. However, DBV TECHNOLOGIES does not guarantee in any way that the information published on the Site is accurate, complete and up to date. DBV TECHNOLOGIES makes no warranty, express or implied, concerning all or part of the Site and/or the information published on it.

The Site is for information purposes only. The information on the Site cannot under any circumstances be considered as a canvassing, an offer of products or services, a proposal, a recommendation, an invitation or a solicitation.

Furthermore, DBV TECHNOLOGIES may not under any circumstances be held liable for any direct or indirect damage, of any nature whatsoever, resulting from access, consultation or use of the Site and/or the information published on it.

Similarly, DBV TECHNOLOGIES may not be held liable in the event of interruption, malfunction or inaccessibility of the Site, the occurrence of bugs, or any damage resulting from fraudulent acts or related to the operation of the Internet. Users acknowledge that they must take all necessary measures to protect their equipment and data, in particular to prevent contamination by possible computer viruses. The user is solely responsible for the use he or she makes of the Site.

The user guarantees and holds DBV TECHNOLOGIES harmless against any action or claim brought against DBV TECHNOLOGIES as a result of the user’s use of the Site or any harmful consequences linked directly or indirectly to the use he/she makes or has made of the Site. The user thus assumes all resulting damages and interest awarded against DBV TECHNOLOGIES or its partners, as well as the legal costs and fees incurred.


4. Hypertext Links

The user is solely responsible for the use made of any hypertext links published on the Site. DBV TECHNOLOGIES does not accept any liability with regard to the access to and the content of third-party sites accessible via hypertext links published on the Site.

Furthermore, hypertext links to the Site may only be created with the prior written consent of DBV TECHNOLOGIES, which may be revoked at any time and without compensation.

Third-party sites that may have inserted a hypertext link to the Site are not under the control of DBV TECHNOLOGIES, therefore DBV TECHNOLOGIES cannot be held liable for their content. The risks associated with the use of these third-party sites are solely the responsibility of their users, who must comply with their terms of use.


5. Personal Data Protection

DBV TECHNOLOGIES, as data controller, undertakes to ensure that the collection and processing of users’ personal data collected on the Site comply with Law No. 78-17 of January 6, 1978 amended in 2004 and Regulation (EU) No. 2016/679 of April 27, 2016.

DBV TECHNOLOGIES has appointed a Data Protection Officer who can be contacted at the following address: dataprivacy@www.dbv-technologies.com.

The personal information collected on the Site is used to contact users who have requested to be contacted and to improve the Site. The processing of this data is based on the legitimate interests pursued by DBV TECHNOLOGIES, namely communication relating to its activities and the promotion of its products.

In order to submit an online request to DBV TECHNOLOGIES and to register for the email alerts, the user must fill in the following fields:

  • For information requests: capacity of the person concerned (consumer or health professional), title, surname, first name, email address, telephone; the fields concerning the company and address are optional.
  • To subscribe to the email alerts: email, last name, first name

DBV TECHNOLOGIES, its subsidiary in the United States and their partners are recipients of the personal data thus collected, which, as such, may be transferred outside the European Union. DBV TECHNOLOGIES has implemented appropriate guarantees in order to regulate these transfers by means of standard contractual clauses, a copy of which you can obtain by sending a request to  dataprivacy@www.dbv-technologies.com.

Data relating to users shall be kept for a period of five years from the last contact.

Each user has the right to request access to, rectification or deletion of his/her personal data or a limitation on the processing of such data; in addition, he/she also has the right to define guidelines concerning the fate of his/her personal data after his/her death.

Under certain conditions, users may also assert a right to object to the processing of their personal data.

These rights can be exercised by sending a request to  dataprivacy@www.dbv-technologies.com.

Finally, users are also entitled to lodge a complaint with a supervisory authority.


6. Intellectual Property

The Site is an intellectual work protected by intellectual property law.

The Site as a whole and each of its component elements (such as images, texts, videos, trademarks, product names, etc.) are the exclusive property of DBV TECHNOLOGIES or have been licensed to it.

The use of all or part of the Site, in particular by means of downloading, transmission, reproduction, representation, distribution or adaptation is strictly prohibited without the prior written consent of DBV TECHNOLOGIES.

As an exception, only private use for non-commercial purposes is permitted.

The sign “dbv technologies” has been registered as a trademark in the name of DBV TECHNOLOGIES. The domain name www.dbv-technologies.com is reserved to DBV TECHNOLOGIES. All other trademarks (trademarks and logos) and distinctive signs that appear on the Site are the property of DBV TECHNOLOGIES, companies belonging to the same group or their partners. Consequently, any reproduction and/or representation, and any use of these distinctive signs are prohibited, without prior written authorization from their owner.


7. Governing Law and Jurisdiction

These Terms of Use are subject to French law, to the exclusion of any other law.

The French courts have territorial jurisdiction to hear any dispute relating to the application, interpretation or execution of these Terms of Use.
